According to Part 2 of Article 16 of the Law of Ukraine No. 2320-IX, waste generators, except for household waste generators, are obliged to process waste independently, if they have a permit, or transfer it for processing to waste management entities that have such a permit.
In the context of reconstruction work aimed at overcoming the consequences of armed conflict and military operations, it is worth emphasizing the special status of the management of debris and waste from destruction. Such actions carried out during the martial law, as well as during the 90-day period after its termination or cancellation in Ukraine, are exempt from the need to undergo an environmental impact assessment (EIA). This provision applies both to the war period itself and to the initial phase of reconstruction.
